Court date set in lawsuit

A trial date has been set in an 11-year-old lawsuit launched by Scintilore Exploration (SLP-T) against prospectors John Larche and Donald McKinnon over proceeds from the sale of properties in the Hemlo gold district of Ontario in the late 1970s.

The parties will meet in Ontario Court (General Division) on April 12, 1999.

Scintilore alleges that Larche, when under contract with the company in 1979, staked seven claims in the Hemlo region for himself without first notifying Scintilore of his intentions. Larche and McKinnon pooled their interests in the areas, and their claims became the site of the David Bell gold mine, owned by Teck (TEK-T) and Homestake Canada, and the Golden Giant mine, including one-quarter of a mining claim now owned by Battle Mountain Canada (BMC-T).

Scintilore is suing the prospectors for past and future proceeds related to the staking and sale of the Hemlo properties, including 3% net smelter return royalties from both the David Bell mine and the quarter claim, as well as stock the men received.
