The public inquiry into the Westray coal mine disaster has been sidelined. The Nova Scotia Supreme Court recently struck down the investigation into the May explosion in which 26 miners died.
The United Steelworkers of America has appealed the court decision. Chief Justice Constance Glube agreed with seven Westray mine managers who challenged the constitutionality of the inquiry and its terms of reference. Four of the mine managers and Westray parent Curragh (TSE) have been charged with 52 counts under the Occupational Health and Safety Act of Nova Scotia. It has also been reported that some of the managers may face RCMP charges of criminal negligence.
