For the record, your April 23 issue referred to “Tin suit fails” in which it was indicated that Noranda lost its suit against the federal government over the International Tin Council affair. In fact, the case in the Supreme Court of Canada was only in reference to whether we could sue the federal government in provincial court or whether it could only be done in federal court. The decision taken at that time was that we must proceed in federal court. It had nothing to do with the merits of our claims concerning the ITC default. As a matter of interest, at the same time as this decision was handed down, a negotiated settlement was agreed to in London, England, whereby the ITC members agreed to pay #182.5 million to the various parties in settlement of the claims. Also for information, Rudolf Wolff, Noranda’s subsidiary, is a commodity broker and in this capacity did not sell tin to the various countries involved in the ITC, which in fact were clients of Rudolf Wolff using the London Metal Exchange.
