Labour Board rules on Giant

The Canada Labour Relations Board has dismissed an application for certification by an independent association seeking to displace the union representing workers at the Giant mine outside Yellowknife, N.W.T.

The board dismissed the application by the Giant Mine Employees Association “for lack of majority support.” The ruling means Local 4 of the Canadian Association of Smelter and Allied Workers (CASAW) remains the bargaining agent for mine workers at Giant. The gold mine is owned by Royal Oak Mines (TSE).

CASAW had opposed the application for certification, alleging the association was “employer-dominated.” The board ruled, however, that employer domination had not been established.

The board excluded replacement workers from participating in the determination of representation but allowed discharged employees to take part in this process.

The labor dispute began in May, 1992. The mine has remained operating except for a short period following the deaths of nine miners last September. The case is being investigated as a multiple homicide but remains unsolved.
