Cream Silver loses appeal

The British Columbia Court of Appeal recently ruled that Cream Silver Mines (VSE) is not entitled to compensation for the loss of its rights to explore and develop mineral claims in Strathcona Park on Vancouver Island, B.C.

The court allowed the government’s appeal from an earlier decision by the province’s Supreme Court in favor of Cream Silver. The company is considering a further appeal to the Supreme Court of Canada.

Cream Silver President Frank Lang said the company is “very disappointed” with the decision, which was based on a view that the company did not have the same rights as former holders of Crown-granted claims in Strathcona Park.
