Quebec prospector sued over claims

A Quebec prospector who was ruled to have registered claims under false pretenses several years ago in the province’s Sept Isles area has been sued successfully by the next person to register the claims. Initial staking of the claims in question was performed by Donald Berube. The Quebec Minister of Energy and Resources declared void the claims staked by Berube while keeping in force the claims staked by Daniel Danis; Danis staked the five Grenier Twp. claims in June, 1986. The Court of Quebec upheld the minister’s decision.

Danis and Norgranit Inc., the company that has since acquired the claims from Danis, sued Berube for damages before the Superior Court, which awarded costs in the amount of $13,127.73. The damages sought relate to staking costs and legal fees. The Superior Court ruling is being appealed.

George Cockburn, director of mining title services with the Quebec Ministry of Energy and Resources, said the ministry believes the higher court ruling is unprecedented, at least in Quebec.
