Judge dismisses Scintilore suit

Supreme Court of Ontario Justice Robert Montgomery ruled Scintilore has no ownership claim to the mine, and an adjacent quarter claim, which is owned by joint (50/50) partners Teck Corp. (TSE) and Corona Corp. (TSE).

Scintilore, which said it will appeal the ruling, re-staked the property last year before filing its suit, alleging the claims were forfeited under the Mining Act of Ontario. The company argued the mining licence of the stock promoter selling the claims had expired, thereby rendering invalid the lease which was issued.

Another lawsuit, involving prospectors John Larche and Donald McKinnon and four companies, launched by Scintilore in 1987, has yet to come to trial.
