Mine partners Teck Corp. (TSE) and Corona Corp. (TSE) brought the motion, with the support of the Ontario government.
Scintilore, which re-staked the 17 claims hosting the David Bell mine and an adjacent quarter-claim (which is being mined as part of the Golden Giant operation) last year, alleges the claims were forfeited under the Mining Act of Ontario and a Crown lease granted to Teck and Corona in 1984 does not legally exist.
After re-staking the claims, Scintilore in August launched a lawsuit disputing the property ownership.
In a separate legal action initiated in 1987 which has yet to go to trial, Scintilore is suing two prospectors, John Larche and Donald McKinnon, as well as Teck, Corona, Hemlo Gold Mines (TSE) and Hemlo Gold subsidiary H.G.M. Inc. The company is claiming all benefits and proceeds owing to the two prospectors from the major Hemlo claims staked by them or on their behalf.
